1. Agreement to Terms

By accessing or using TrashAndDash ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

TrashAndDash is a marketplace platform that connects customers needing junk removal services with independent haulers. We facilitate connections but do not provide junk removal services directly.

3. User Categories

3.1 Customers

Customers use the Service to:

• Post junk removal requests
• Receive quotes from haulers
• Select and communicate with haulers
• Pay haulers directly for services

3.2 Haulers

Haulers use the Service to:

• View available jobs in their area
• Accept Lite Load jobs or submit quotes
• Communicate with customers
• Receive payment directly from customers

4. Independent Contractor Relationship

Haulers acknowledge and agree that:

• They are independent contractors, not employees of TrashAndDash
• They are responsible for their own taxes, insurance, and legal compliance
• They set their own schedules and choose which jobs to accept
• They provide their own vehicles, equipment, and tools

5. User Responsibilities

5.1 All Users Must:

• Provide accurate and truthful information
• Maintain the security of their account
• Comply with all applicable laws and regulations
• Treat other users with respect and professionalism

5.2 Customers Must:

• Accurately describe items for removal
• Ensure items are accessible as agreed
• Pay haulers promptly for completed services
• Not request removal of hazardous materials without disclosure

5.3 Haulers Must:

• Maintain appropriate licenses and insurance
• Dispose of items legally and responsibly
• Honor accepted jobs and quoted prices
• Communicate professionally with customers

6. Payments and Fees

• All payments are made directly between customers and haulers
• TrashAndDash does not process payments or take commissions
• Lite Load jobs are $50 flat rate to the customer
• Large Load pricing is determined by hauler quotes
• Additional fees may apply for special items (mattresses, appliances, etc.)

7. Prohibited Activities

Users may not:

• Use the Service for any illegal purpose
• Misrepresent their identity or affiliation
• Harass, threaten, or harm other users
• Attempt to circumvent the platform after initial connection
• Post false or misleading information
• Request or offer services outside the scope of junk removal

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TRASHANDASH MAKES NO WARRANTIES ABOUT THE QUALITY, SAFETY, OR LEGALITY OF HAULER SERVICES. USERS ENGAGE WITH HAULERS AT THEIR OWN RISK.

9. Limitation of Liability

TRASHANDASH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF THE SERVICE OR ANY HAULER SERVICES.

10. Indemnification

You agree to indemnify and hold harmless TrashAndDash from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or platform notification.

14. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which TrashAndDash operates, without regard to conflict of law provisions.
